How is Delta 9-THC Legal?

Delta 9 THC is derived from the hemp plant, not marijuana, which contains 0.3% or less of Delta 9 THC on a dry weight basis. Any substance that contains more than 0.3% Delta-9 THC by dry weight volume is to be defined as a controlled substance.
